Article 242
Public Service Commission
: (1) There shall be a Public Service Commission in Nepal which shall consist of a Chairman and four other members.
(2) The President shall appoint the chairman and members of the Public Service Commission on the recommendation of the Constitutional Council (3) At least fifty percent of the members of the Public Service Commission shall be from among the persons who have been in government service for a period of twenty years or more and the remaining members shall be research, research, teaching or research in science, technology, art, literature, law, public administration, sociology or other fields of national life. They will be appointed from among the people who have gained fame by doing some other important work.
(4) The term of office of the chairman and members of the Public Service Commission shall be six years from the date of appointment.
(5) Chairman and members appointed according to sub-section (2) cannot be re-appointed. However, a member can be appointed to the post of chairman and if such a member is appointed to the post of chairman, the period of membership will also be counted as a pair when calculating his term of office.
(6) Notwithstanding anything contained in sub-section (4), the post of chairman or member of the Public Service Commission shall be vacant in any of the following cases:-
(a) If he tenders his resignation in writing to the President,
(b) If he attains the age of sixty-five years,
(c) If the resolution of impeachment is passed against him in accordance with Article 101,
(d) If, on the recommendation of the Constitutional Council, the President dismisses him from office on the recommendation of the Constitutional Council that he is unable to perform his duties while in service due to physical or mental infirmity,
(e) In case of his death.
(7) A person having the following qualifications shall be eligible for appointment to the post of Chairman or Member of the Public Service Commission:-
(a) Having obtained a Master's Degree from a recognized University,
(b) Not being a member of any political party at the time of appointment (c) having completed the age of forty-five years, and
(d) having high moral character.
(8) The remuneration and service conditions of the Chairman and members of the Public Service Commission shall be in accordance with the federal law. By changing the remuneration and conditions of service to the detriment of the chairman and members of the Public Service Commission as long as they remain in office.No. But this arrangement will not be applicable in the case of declaration of emergency due to extreme economic disorder.
(9) A person who has been a chairman and a member of the Public Service Commission shall not be eligible for appointment to other government services. However, nothing written in this sub-section shall be deemed to be a hindrance to being appointed to a political position or to a position to investigate, investigate or investigate a subject or to submit an opinion, opinion or recommendation after studying or investigating a subject.
