(1) Notwithstanding anything written elsewhere in this Act, according to the Commission for Investigation of Abuse of Authority Act, 2048, if any civil servant is written to take departmental action by the said commission and according to the prevailing law, the departmental punishment shall be imposed accordingly.
(2) Notwithstanding anything contained elsewhere in this Act, a civil servant who is absent from his office without taking leave contrary to section 41 may be suspended and his salary deducted. The period thus missed will not be counted in the period of service.
(3) Notwithstanding anything else written in this Act, an employee who is absent for a period of more than ninety consecutive days without sanction of leave shall not be excused. In case of making an appearance, the official who made the appearance will be subject to departmental action according to Section 60 and the salary and allowances of the employee who made the appearance will be recovered from the official who made the appearance in the same way as government dues.
