Rule 232
Motion to approve declaration or order of state of emergency

(1) In accordance with clause (1) of Article 273 of the Constitution, if the President declares or issues a state of emergency in the state of Nepal, the Prime Minister shall give notice of the proposal to the Secretary General within one month from the date of issuance of the order.
(2) In any meeting five days after receiving the notification of the announcement or order as per sub-rule (1), the speaker shall fix the day and time for presenting the proposal.
(3) On the day and time specified in accordance with sub-rule (2), the Prime Minister shall submit a proposal to the meeting by giving a statement regarding the grounds and reasons for declaring a state of emergency or issuing an order with the permission of the Speaker.
(4) After the submission of a proposal according to sub-rule (3), the Speaker shall set a time period to discuss the proposal. The discussion will end after the prime minister or a minister authorized by him gives answers to the questions raised during the discussion if he is unwell or is unable to attend due to uncontrollable circumstances.
(5) After the discussion in accordance with sub-rule (4) is over, the speaker will present the said proposal in the meeting for decision.
(6) The decision of the assembly on the motion presented in accordance with sub-rule (1) shall be by division of votes with the signatures of the members.
(7) If the session of the Federal Parliament is not in session at the time of issuance of the announcement or order as per sub-rule (1), the session shall be convened within fifteen days from the date of issuance of such announcement or order.
