Section 12A
-Special provisions relating to regulation of restricted leave:
(1) If an industry, establishment, company or organization that is in continuous operation at the time of the commencement of this section is purchasing and using land in excess of the limit specified in this Act for the operation of such industry, establishment, company or organization without the approval of the Government of Nepal, if it exceeds the limit once within three months from the date of commencement of this section. Because of the confirmation of the justification of the need for land, the owner can submit an application to the government.
(2) After conducting necessary investigation on the application received as per sub-section (1), if it is found to be appropriate, a fee of one hundred and fifty thousand rupees per bigha in Terai and inner Madheshkoh, fifty thousand rupees per plant in Kathmandu Valley and ten thousand rupees per plant in case of other hilly areas shall be issued in accordance with this Act. The notified order will be able to grant permission to keep the land within the limits. In this way, the government of Nepal will be able to specify the necessary conditions.
(3) Notwithstanding anything written elsewhere in this section, the government will not grant permission to any industry, establishment, company or organization that is not in operation: or is not in a condition to operate due to financial, technical or other reasons.
