Section 35

No one should encourage anyone to commit any offence.
(2) For the purpose of sub-section (1), if anyone incites anyone to commit any offence, he shall be deemed to have given incitement.
(3) If a separate punishment is provided for in this Code, the person who gives incitement shall be punished accordingly and if not, he shall be punished as follows:-
(a) If the offense is committed as per the abetment, the punishment shall be the same as if he committed the offense himself,
(b) If the offense is not committed as admonished, half of the punishment prescribed for that offence.
(4) For encouraging a person to commit an offence, if such person commits another offense as a result of the effect or possible consequence of such abeyance, the person giving the abeyance shall be punished as if he had committed such offense himself.
