Rule 153
Matters to be considered when performing tasks related to delegated management
(1) While discussing the delegated management, the committee should also take into consideration the following matters:-(a) Whether or not rules, guidelines, procedures, regulations and orders etc. to be made by the Government of Nepal under the authority delegated by the law, (b) the purpose of the constitution or the law Whether or not rules, guidelines, procedures, regulations and orders etc. have been made in accordance with it, (c) Whether or not the matters prescribed by the Act are included in the rules, guidelines, procedures, regulations or orders, (d) Rules, guidelines, whether or not the procedures, regulations and orders etc. have been imposed, (e) whether the rules, guidelines, procedures, regulations and orders etc. made in accordance with the provisions delegated by the law directly or indirectly interfere with the jurisdiction of the court or not, (f) the constitution or the law clearly states that In relation to an arrangement that does not provide any rights, whether the rule is retroactive or not, (g) whether any expenses should be incurred from the reserve fund or other government funds for rules, guidelines, procedures, regulations and orders, etc. Whether or not there are guidelines, procedures, regulations and orders etc., (i) whether or not unnecessary delay has been made in publishing the rules, guidelines, procedures, regulations and orders etc. made in accordance with the provisions delegated by the Act and submitting them to the Federal Parliament Secretariat, and (j) ) Whether or not any explanation is necessary to clarify the intent of the rules, guidelines, procedures, regulations and orders etc. made in accordance with the provisions delegated by the Act. ) since mentioned above, if any additional rules, guidelines, procedures, regulations and orders etc. are found to be fully or partially repealed or amended, a recommendation with the reasons thereof, and (b) what the Government of Nepal has done to fulfill the assurances given by the Minister on behalf of the Government to the Assembly or Committee from time to time. -What steps have been taken after studying itInstructions given to the bound body. (3) In the report according to sub-rule (2), if it appears that the assembly needs to be informed about other matters related to any rule, that matter must also be disclosed in the report. (5) If the report presented by the committee and any amendments are submitted, the chairman will set a day and time to discuss the matter. (6) The relevant minister will answer the questions raised during the discussion on the report and amendments as per sub-rule (2). (7) After the decision on the amendment, the recommendations of the report will be presented to the assembly for decision as per the situation or with the approved amendment. (8) The secretary will inform the relevant minister of the decision according to sub-rule (7). (9) The relevant minister must implement the recommendations of the committee passed by the assembly. (10) In the course of implementing the recommendation according to sub-rule (9), the minister concerned shall inform the Federal Parliament about the amended or repealed rules.
