Section 26
Promotion

(1) In the case of promotion to the gazetted post of the Legislature-Parliament Service by performance evaluation, the promotion shall be done on the recommendation of the promotion committee.
(2) Notwithstanding anything contained elsewhere in this Act, the following shall be promoted to the gazetted special category posts of the Legislature-Parliament Service:-
(a) For promotion to gazetted special category vacancies, the promotion committee will recommend the candidates who have obtained the highest marks based on the performance evaluation of three times the number of vacant posts as far as available from among the potential candidates and among the candidates so recommended, the committee will promote the candidates deemed suitable on the basis of seniority and efficiency.
(b) In order to be a potential candidate for a specific category position as per Clause (a), a gazetted first class employee must have also passed the high level management training prescribed by the Government of Nepal. However, this provision will not apply to promotion within one year after the commencement of this section.
(c) When calculating the performance evaluation for the promotion of a specific category as per clause (a), the minimum service period of the year required for the promotion shall be calculated from the performance evaluation of the last year.
(3) There will be a promotion committee as specified to make recommendations for promotion based on performance evaluation in the gazetted posts of the Legislature-Parliament Service.
