Rule 195
Presentation of the Treaty
(1) According to Article 279 of the Constitution, if a treaty is to be approved, acceded to, accepted or supported, the concerned Minister shall disclose the following details along with the nature of the treaty and attach a certified copy of the authentic copy of such treaty in both English and Nepali languages to the Secretary General or in his absence at any meeting five days after giving notice to the Secretary Proposals related to it may be submitted:- (a) The purpose of the treaty to be approved, acceded to, accepted or supported, the main provisions therein and the reasons why the State of Nepal or the Government of Nepal should be a party to such a treaty and its rationale, (b) from such a treaty The national interest and the obligations to be fulfilled from it, (c) Should a separate law be made to implement such a treaty or not? Should there be separate institutional and other arrangements or not? If applicable, related details, (d) In case of multilateral treaty, if there are any countries that are party to such treaty, the name and number of such countries, (e) In relation to the treaty, any interpretation or opinion made by the mechanisms under the treaty, such interpretation or opinion, and (f) In multilateral treaty If a reservation is to be made, the reason for it and the proposal for the reservation. (2) After receiving the notice as per sub-rule (1), the secretary shall provide the copy of the said treaty to the members at least two days before the date of its presentation at the meeting. (3) Ratification of the treaty, When presented at the meeting for inclusion, approval or support, the concerned minister will make a statement. (4) According to sub-rule (3), after the minister makes a statement, the chairman will determine the time period for general discussion on the treaty.
