Section 109
Arrangements to be made if the condition of the insurer does not improve
If the condition of the insurer taken under control under this Act does not improve, the special management group may take the following actions:-
(a) To sell and transfer the forfeited shares in the auction increment within the specified period,
(b) to recommend to the Authority the amalgamation of such insurer with another insurer within the prescribed time,
(c) to transfer the insurance business of such insurer to another insurer and recommend to the authority to cancel the license of the said insurer,
(d) To recommend to the authority to improve the position of the insurer in accordance with section 110,
(e) to recommend to the Authority the initiation of proceedings relating to the winding-up of such insurer.
