Rule 69
Time-and-Work Plan of Kabuliyat Forest

(1) According to sub-rule (6) of rule 68, if approval is given by the government of Nepal to provide the forest, the department shall make such organized organization to prepare an action plan for the forest within the scope of the Act and this regulation.
(2) Before approving the action plan of Kabuliyati Forest, the organized organization that wants to get Kabuliyati Forest should conduct an environmental study in accordance with the prevailing law.
(3) If the action plan of the forest under sub-rule (1) is submitted, the department will approve such action plan and issue a certificate of forest under the format of schedule-40 for a maximum period of 30 years, after approving such action plan. Thus: The certificate shall be renewed annually.
(4) When the department prescribes conditions according to sub-rule (3), the proponent shall be prohibited from doing the following activities:-
(a) River channel flowing within the forest area, the source of the river is blocked: to do or return,
(b) to prevent the growth of vegetation; To cause harm to animal habitats, to spoil natural or physical features or to adversely affect the ecological status of wetlands,
(c) to encroach on forest areas other than those taken under the auspices,
(d) To use any kind of pesticide in a way that causes harm to aquatic birds or any other kind of animals, birds or animals,
(e) to extract or mine stone, gravel, sand or soil,
(f) To do or cause to disturb the social and cultural customs and cultural and religious places of the surrounding local residents,
(g) To create or cause disruption in the use of traditional rights such as roads, canals and: unrestricted use of water resources,
(h) To spend the night, camp, light fire, make noise or make noise elsewhere than in the designated area as per the approved action plan,
(j) To do any act affecting wildlife or local communities,
(h) 8 To blacktop the road inside the Kabuliyati forest.
(5) Pursuant to the approved action plan in Kabuliyat ForestInfrastructure construction: Apart from the road, it should be done only in ten percent of the area of ​​Kabuliyyat forest - or five hectares, whichever is less.
(6) If the action plan of Kabuliyati Forest needs to be amended, the department may make necessary amendments to the action plan after taking the consent of the Ministry.
(7) After the expiration of the Kabuliyati Forest, the movable and immovable property in the Kabuliyati Forest shall be handed over to the Government of Nepal through the Ministry. The Ministry of Forests can either manage the concessions returned in this way or let it be managed by an organized organization through competition. But if the organized organization that has taken the recognized forest wants to take back the same recognized forest, the Nepalese government can re-evaluate such forest area and provide it for a maximum period of thirty years.
(8) The organization receiving the recognition forest shall start the work according to the approved action plan within the period mentioned in the agreement.
(9) If the work cannot be started in accordance with the approved action plan within the period mentioned in the contract, if an application is made showing reasonable reasons, the department may extend the period for starting the work of the confessional forest for a maximum period of six months, and if the work is not started according to the action plan within that period, the confessional 8 forest. The contract with the receiving organization is automatically cancelled. And such forest will be converted into forest managed by the government.
(10) After providing the certificate of recognition forest according to sub-rule (3), the department shall attach the same and give the information to the ministry, provincial ministry, directorate and division forest office.
(11) Tourism programs as per schedule-41 can be conducted in the recognized forest available according to this rule.
