(1) According to sub-section (2) of section 43 of the Act, if there is a demand for mining minerals such as gold, silver, copper, iron based on the investigation conducted according to sub-section (1) of the Act, the Government of Nepal may give permission to use any part of the national forest. .
(2) In accordance with sub-rule (1), those who wish to mine minerals must submit an application to the Ministry of Industry, Commerce and Supply through the Department of Mines and Geosciences along with the following documents:-
(a) License obtained for mining according to prevailing law,
(b) Environmental Study Report,
(c) Mining Scheme,
(d) The address, char and area of ​​the excavation site,
(e) Description of the project or industry that uses mined minerals as industrial raw materials, (f) Industry registration certificate of industries that use minerals as industrial raw materials,
(g) If any part of the national forest area demanded for the extraction of minerals is under the management of the user group, the decision of the general meeting of the user group.
(3) Section 43 of the Act. According to the restrictive phrase of sub-section (2) of: When submitting an application to extract raw materials required for a project of national priority or a project of national pride or investment approved by the Investment Board, in addition to the documents mentioned in sub-rule (2), the following documents must be submitted:-
(a)-Decision of the National Planning Commission in the case of national priority projects,
(b) Board's decision along with the project development agreement in case of projects where the investment has been approved by the Investment Board (c) In case of a project of national pride, an official proof document.
(4) If an application is received according to sub-rule (2) or (3), approval from the Board of Investment in the case of the project, and in the case of other projects the Ministry of Industry, Commerce and Supply shall send the necessary documents and recommendations to the Ministry.
