Rule 53

(1) A community forest consumer group may allow a separate group of consumers below the poverty line within such consumer group to use any part of the community forest to generate income by developing, protecting and utilizing the community forest.
(2) According to sub-rule (1), the matter of allowing the land of community forest to be used must be mentioned in the approved action plan of the respective community forest.
(3) In order to identify consumers who are below the poverty line as per sub-rule (1), the poor provided by the relevant agency of the Government of Nepal. Family identity card should be considered as basis. In the absence of such an identity card, the level of prosperity of the consumer shall be based on the land owned by the consumer and the period of time the family can eat from the produce on that land, employment and income earning conditions, number of livestock, access to economic and social opportunities, etc.
(4) According to this rule, while providing any part of the community forest for income generation to the consumers below the poverty line, priority shall be given to the extremely poor, landless, marginalized, single women and Dalit families among such consumers.
(5) When sub-user households identified as per sub-rule (3) and (4) are allowed to use the land of the forest area as per sub-rule (1), the community forest user group may give any part of such community forest area that is considered appropriate for income generation either individually or collectively. (6) According to sub-rule (5), when allowing the land to be used in the forest area, an agreement must be made between the community forest user group and the group of households below the poverty line in accordance with schedule-31.
(7) Agreement according to sub-rule (6): Provision shall be made for the related household to receive the income received from the income-earning activities conducted by such household in such forest area.
(8) In accordance with sub-rule (1), the land of the forest area shall be given to the consumers who are below the poverty line: in accordance with sub-rule (13) of rule 46, it shall be given only for the duration of the action plan of the concerned consumer group.
(9) End of the period as per sub-rule (8).After that, while allowing consumers who are below the poverty line to use the land in the forest area, according to sub-rule (3), consumers who are below the poverty line should be allowed to use the land.
