(1) Pursuant to sub-rule (2) of rule 3, the government of Nepal may provide the right of occupancy of the national forest area, which has been approved to change the land use, to the relevant agency. In this way, the details of the permission to change land use and the provision of occupancy rights should be made available to the relevant provincial ministries and directorates.
(2) According to sub-rule (1), the body that receives the usufruct shall deposit the amount estimated by the department into the fund to plant trees on the land designated by the department or division forest office and to protect it for five years.
(3) In case the Government of Nepal has provided the usufruct of the national forest area according to sub-rule (1), the department shall enter into an agreement with the entity acquiring the usufruct and issue a certificate in the format as per Schedule-1.
(4) Occupancy rights according to sub-rule (1): If the trees on the land of the provided national forest area have to be removed during the construction of necessary physical structures, they should be removed only with the approval of the provincial ministry.
(5) For the purpose of research and information related to aerial radar, telecommunications tower, environment, climate change, weather or disaster, any structure of the Government of Nepal should be placed within the national forest area: the Government of Nepal shall place such structure. It can be provided to the agency that has the right of occupancy of the land in the forest area as needed.
(6) For the purpose of sub-rule: (1) managed by user group: If the right of occupancy is to be granted in the forest area, the consent of the user group concerned shall be obtained. In this way, when the consumer group gives consent, the general meeting of that group will have to make a decision.
(7) According to sub-rule (1), the body acquiring the usufruct shall use the national forest area only for the purposes for which it has acquired the usufruct.
(8) In accordance with the Act and this regulation, the right of private ownership in the national forest area cannot be transferred to anyone without the approval of the Government of Nepal.
(9) The Provincial Forest Director shall monitor the use of the land provided with usufruct in accordance with this rule and shall prepare an annual report related to such monitoring and submit it to the Provincial Ministry and Department.
