Rule 91

(1) According to rule 90, if the government of Nepal decides to use any part of the national forest for the operation of the development project, then the development project shall provide the land with land structure on which the forest can be developed in accordance with subsection (2) of section 42 of the Act.
(2) If the development project fails to provide land according to sub-rule (1), it shall be sent in writing to the Land Acquisition Facilitation Committee under Rule 92 for the purpose of providing land.
(3) If written according to sub-rule (2), the Land Acquisition Facilitation Committee under Rule 92 shall facilitate the purchase of land. (4) The Facilitation Committee as per rule 92 shall arrange for the purchase of land in accordance with sub-rule (3) by making an agreement between the developer and the seller of the land.
(5) For the purpose of maintaining the land under sub-rule (1) or (4) as a forest area, the Division Forest Office shall first pass the registration in the name of the development project and immediately send it in writing to the concerned land office to pass the registration in the name of the Government of Nepal.
(6) If written in accordance with sub-rule (5), the concerned land office shall pass the registration in the name of the development project related to such land and after the registration is passed in the name of the development project, it shall immediately pass the registration in the name of the Government of Nepal and establish the national forest area.
(7) By-laws. According to (6), after the forest area is established in the name of the Government of Nepal, according to section 6 of the Act, the relevant land office and the local level shall deduct the value of such land and establish the national forest area and keep records.
(8) According to sub-rules (6) and (7), the ministry shall publish the details of the land in which the national forest area has been established in the Nepal Gazette.
(9) If the land cannot be acquired in accordance with this rule, the Land Acquisition Facilitation Committee under Rule 92 shall make a recommendation to the Administration Department.
