Rule 30
Auction sale of herbs and other forest produce
(1) Notwithstanding anything contained in rule 29, the Ministry may direct the collection and sale and distribution of a particular species of herb to the highest bidder by bidding.
(2) The Ministry may give the maximum royalty to the person who offers the highest royalty: industry, company or cooperative organization, for a certain period of time, from among the herbal and botanical forest produce as per Schedule-7 and Schedule-8, so that no particular forest produce falls below the value of that schedule.
(3) Notwithstanding anything else written in this rule, the vegetable forest produce of the species specified by the Provincial Ministry shall be sold and distributed by the Divisional Forest Officer through the Bolakbol system.
(4) In the case of mineral forest produce within the national forest, it shall be in accordance with section 43 of the Act.
(5) River stones, gravel or sand from the river flowing within the national forest area will be collected and distributed through open competition by the concerned local level on the recommendation of the Divisional Forest Office in the amount determined by the environmental study report, subject to the criteria and time period prescribed by the Government of Nepal by publishing a notice in the Nepal: Gazette. .
(6) If there is a demand for river stone, gravel or sand required for a national priority project, a project of national pride or a project approved for investment by the Investment Board, the person or organization buying and selling according to sub-rule (5) such stone, gravel or sand as requested Such a project should be made available and sold elsewhere.
(7) Notwithstanding anything written in sub-rules (5) and (6), for projects of national priority, projects of national pride or projects approved for investment by the Board of Investment, within the national forest: river stone, gravel or sand of a specific location; If it is necessary, the Government of Nepal can make it available by taking the fee as per Schedule-8.
