Rule 48
Forest management and collection of forest products
(1) The community forest user group shall manage the respective community forest in accordance with the approved action plan.
(2) The Community Forest User Group shall ensure that the annual works of forest protection, management and development mentioned in the approved action plan are completed within the time specified in such action plan.
(3) The collection of forest produce should be done in such a way that the amount of annual allowable cutting does not increase by managing the forest in accordance with the approved action plan.
(4) Community forest - built according to the action plan approved by the consumer group; Before collecting the yield, the approval of the Divisional Forest Office should be obtained after evaluating the crop with the help of the Sub Divisional Forest Office. But if it is collected only for internal distribution within the community forest user group, it can be collected with the support and consent of the Sub Division Forest Office and the Sub Division Forest Office should give the information to the Division Forest Office.
(5) Notwithstanding anything written in sub-rule (3), if forest produce rots or perishes due to catastrophic events such as floods, landslides, snowfall, windstorm, fire, insect and disease outbreaks, such forest produce shall be removed from the forest area. Exceeding the annual allowable cut quantity specified in the approved action plan for removal or collection may be cut.
(6) In case of damage to the forest produce due to the disaster mentioned in sub-rule (5), the community forest user group shall inform the Divisional Forest Officer as soon as possible along with the preliminary details of the damage. If such information is received, the Divisional Forest Officer immediately deputes a technical staff and conducts an on-site inspection of the district along with the date of the incident and the details of the damage; The disaster management committee should be informed.
(7) At the request of the Community Forest User Group, the Divisional Forest Officer shall measure and evaluate the damaged forest produce according to sub-rule (6) and, on the recommendation of the District Disaster Management Committee, take the approval of the Provincial Ministry through the Directorate and record such forest produce.Such community forest user group may be allowed to collect and sell and distribute.
(8) According to sub-rule (5), after the collection of wood and firewood, the amount of annual allowable cutting of the action plan should be reviewed and included in the action plan.
(9) Regardless of what is written in this rule, if the value of trees that fell naturally by themselves is more than the annual allowable felling amount, it can be collected by taking the consent of the Division Forest Office to match the annual allowable felling amount of the next year.
(10) The community forest user group shall mobilize the members of the group with the support and investment of their own resources or banks and financial institutions while collecting the wood and firewood obtained from the community forest in accordance with the approved action plan.
(11) According to sub-rule (10), if the members of the community forest user group cannot be mobilized to collect wood, firewood; The consumer group shall call for sealed bids and compete with the firm or company that agrees to collect the forest produce at the lowest price, by issuing a collection permit in the format as per Schedule-26 and start the collection work. But the firm, industry or company involved in the collection of forest produce can participate in the sale process of such forest produce: No.
(12) The Community Forest User Group shall spend in accordance with sub-rule (11) while collecting wood and firewood in such a way that it does not exceed the approved district rate.
(13) The wood and firewood collected in accordance with this rule shall be deposited in a safe place as stipulated in the approved action plan by the community forest user group.
(14) For the collection of wood, herbs and other forest products other than firewood, the community forest user group shall issue a collection permit in the format as per Schedule-26.
