Rule 124
Management of disinheritance and seventy two wood, firewood

(1) The Division Forest Office shall collect the uninherited and seventy-two pieces of wood and firewood within its jurisdiction and dispose of them in a safe place.
(2) In accordance with sub-rule (1), the divisional forest officer shall submit a notice to the relevant local level and divisional forest office with a period of thirty days to claim such wood and firewood (with full details and attached details) of uninherited and seventy-two wood and firewood in Ghatgaddi. br> (3) The person, consumer group, organization or body claiming the timber, firewood mentioned in the notice as per sub-rule (2) shall submit their claim application to the Division Forest Office within the period specified in such notice along with the following supporting documents:-
(a) Proof of receipt of wood, firewood or proof of ownership of wood, firewood,
(b) Letter of recommendation from the concerned ward office,
(c) Proof of any other claim.
(4) If an application for entitlement is received as per sub-rule (3), the Divisional Forest Officer shall appoint a technical staff to study the matter and submit a report with a definite opinion whether the entitlement is met or not. On the basis of such study report, the Divisional Forest Officer shall decide on the claim application. (5) If the Divisional Forest Officer makes a decision based on the application made in accordance with sub-rule (3), such wood, firewood shall be handed over to the concerned person, consumer group, organization or body after taking the expenses incurred while collecting such wood, firewood.
(6) In case the wood and firewood obtained after the decision to reach the claim in accordance with sub-rule (5) are to be sold for commercial purposes, the consent of the Division Forest Office shall be obtained.
(7) If the Divisional Forest Officer makes a decision regarding timber and firewood as per sub-rule (1), the person who is not satisfied with such decision may file an application before the State Forest Director within thirty five days from the date of such decision and the decision made by the State Forest Director on such matter shall be final.
(8) By-lawsAccording to (1), the wood and firewood, which have not been claimed or have been decided not to be claimed, shall be auctioned by the Divisional Forest Officer in accordance with Rule 25. The amount received from the auction sale should be deposited in the provincial reserve fund of the respective province.
