(1) The Divisional Forest Officer may, in consultation with the Directorate, formulate a land use plan for a particular forest area within his jurisdiction to maintain a balance between forest conservation, enhancement, management and environment and development.
(2) The land-use plan prepared according to sub-rule (1) shall be submitted to the Department by the Divisional Forest Officer after taking the consent of the Provincial Ministry for approval.
(3) If it is found necessary to modify the land use plan received according to sub-rule (2), the department shall submit it to the Ministry for the approval of the Government of Nepal with its opinion, including the modification or making the modification.
(4) Sub-rule (3). The Ministry will submit the land use plan received as per the above to the Government of Nepal Council of Ministers for approval and the Government of Nepal Council of Ministers will be able to approve such a plan.
(5) Notwithstanding anything else written in this rule, the Government of Nepal may, if it deems it necessary, formulate and approve a land use plan in any forest area.
