Rule 88
Application for use of national forest area
(1) If it is found from the feasibility study according to sub-rule (2) of rule 87 that the national forest area should be used and from the environmental study report: If it is found that there will be no significant adverse impact on the environment, the development project should include the following details and apply to the ministry through the relevant ministry or agency for approval to use the national forest area. Should be given:-
(a) Feasibility study report or report explaining the factual basis and reasons for requiring forest area,
(b) In case of a development project for which a permit has been issued by an agency, a copy of such permit,
(c) approved environmental study report, (d) area of national forest to be used and details including cost of tree saplings to be removed,
(e) Detailed study report (DPR) of the development project, detailed engineering design report etc. related to the approved program documents,
(f) Decision of National/Planning Commission in case of National Priority Projects,
(g) Investment: Board's decision along with the project development agreement in case of projects where investment has been approved by the Board (h) In case of a project of national pride, its official proof document,
(i) Letter with the decision that the concerned provincial government has ensured the budget in the case of priority development projects operated by the 8 provincial governments,
(h) In the case of priority development projects operated by the local level, a letter containing the decision that the relevant local level has ensured the budget.
(2) Notwithstanding anything written in sub-rule (1), if approved by the investment board, in the case of development projects, an application must be submitted to the ministry through that board.
(3) When submitting an application in accordance with sub-rule (1), in the case of priority development projects of the provincial government, the decision of the relevant provincial government and of the local level in the case of priority development projects of the local level shall also be submitted.
