Rule 102
Provisions relating to removal of trees

(1) Upon receipt of the agreement between the department and the development project or mineral working entity, the Division Forest Office shall evaluate the trees to be removed for the operation of such project and send it to the directorate and after it is verified by the directorate, the felling permit shall be provided. The relevant agency should provide the necessary technical manpower for tree canopy assessment work.
(2) According to Section 42 of the Act, if additional trees need to be removed during the operation of such project in the forest area given to be used for the development project, the Ministry may approve the removal of such trees after necessary investigation.
(3) In the event that trees within the right of way need to be removed during the expansion of roads or canals that have received approval in accordance with Section 42 of the Act or have been established by the Government of Nepal prior to the commencement of the Forest Act, 2049, the department shall, upon the recommendation of the concerned body, carry out necessary investigations and approve the removal of such trees. can
(4) After receiving the approval as per sub-rule (2) or (3), such development project shall deposit the amount as per sub-rule (4) of rule 93 in the fund.
